1. Acceptance of Terms
Welcome to PokeParty ("we," "our," "us," "Company," or "PokeParty"). These Terms of Service ("Terms") govern your use of our mobile application PokeParty (the "App"), available on Apple App Store and Google Play Store, and our website pokeparty.app (the "Website"), collectively referred to as our "Services."
By downloading, installing, accessing, or using the App, or by visiting and using the Website, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the Services. We reserve the right to modify these Terms at any time, and your continued use of the Services constitutes acceptance of the modified Terms.
2. Eligibility Requirements
By using PokeParty, you represent and warrant that:
- Age: You are at least 13 years old (or 16 in EU/UK)
- Legal Capacity: You have the legal capacity to enter into a binding agreement
- Valid Account: All information you provide is accurate and current
- Compliance: You will comply with all applicable laws and regulations
- Pokemon GO Account: You have a legitimate Pokemon GO account in good standing with Niantic
PokeParty is not intended for children under 13 years of age (16 in EU/Switzerland/UK). If you are under 13, do not use PokeParty.
3. Platform Overview
3.1 Mobile Application
Comprehensive Pokemon GO Companion App:
- Requires user account creation with email
- Complete profile with Pokemon GO trainer details
- Raid Coordination: Create and join raid rooms with auto-match making
- Friend System: Share friend codes, quick share system, public directory
- Events Calendar: Pokemon GO events with categories and filtering
- PvP Rankings: Battle analysis, league rankings, team building tools
- Leaderboards: Community rankings and statistics
- Push Notifications: Raid updates, friend requests, system alerts
- Premium features through optional rewarded ads
3.2 Website
Read-Only Directory:
- NO user accounts or authentication
- Displays public friend codes shared via mobile app
- Users cannot interact or modify data on website
- All functionality requires mobile app
4. Account Registration and Security
4.1 Account Creation
When creating your account, you must:
- Provide a valid, personal email address
- Create a secure account (responsibility to keep credentials safe)
- Verify your identity through OTP (one-time password)
- Accept these Terms of Service
- Be truthful about your Pokemon GO trainer information
4.2 Your Responsibilities
You are solely responsible for:
- Maintaining the confidentiality of your login credentials
- All activities that occur under your account, whether or not authorized by you
- Notifying us immediately of unauthorized access
- Keeping your email address secure and up-to-date
4.3 Account Suspension
We may suspend or terminate your account immediately if we believe you have violated these Terms or engaged in unauthorized or illegal activity.
5. User Responsibilities
As a PokeParty user, you agree to:
- Use PokeParty solely for legitimate raid coordination
- Treat other users with respect and basic human decency
- Not impersonate other users or misrepresent your identity
- Maintain accurate information in your trainer profile
- Report any security vulnerabilities to us immediately
- Comply with all applicable laws and Niantic's Terms of Service
- Not attempt to access PokeParty using automated tools or bots
6. Acceptable Use Policy
PokeParty is a comprehensive Pokemon GO companion app. Acceptable uses include:
- Raid Coordination: Creating and joining raid rooms, using auto-match making, coordinating raid participation
- Friend Discovery: Sharing friend codes, browsing the friend code directory, using Quick Share system for visibility
- Event Planning: Viewing Pokemon GO events calendar, planning raid participation, tracking Community Days and events
- Battle Analysis: Researching PvP rankings, comparing Pokemon movesets, analyzing battle matchups, team building
- Community Engagement: Viewing leaderboards, comparing raid statistics, tracking personal achievements, community metrics
- Profile Management: Updating trainer information, managing profile visibility, tracking raid history
- Premium Features: Watching optional rewarded ads for extended friend code visibility (60-minute Quick Share placement)
What NOT to Use PokeParty For:
- Selling or trading Pokemon accounts
- Offering services unrelated to Pokemon GO coordination
- Dating or romantic solicitation
- Commercial advertising or promotion (outside paid features)
- Gambling or unauthorized money exchange
- Circumventing ad or payment systems
7. Prohibited Activities
The following activities are strictly prohibited on PokeParty:
7.1 Pokemon GO Violations
- GPS Spoofing: Using fake location services or location manipulation tools
- Cheating: Using bots, automated tools, or exploits
- Account Sharing: Sharing your Pokemon GO account credentials
- TOS Violations: Any activity that violates Niantic's Pokemon GO Terms of Service
- Promotion of Violations: Encouraging or helping others violate Niantic's rules
7.2 Harassment and Safety
- Harassment: Abusive, threatening, or harassing communications
- Hate Speech: Discrimination based on race, ethnicity, gender, orientation, or religion
- Doxxing: Sharing personal information without consent
- Threats: Any threats of violence or harm
7.3 Platform Abuse
- Spam: Excessive messages or raid room creation
- Raids Abandonment: Repeatedly joining and abandoning raids without reason
- False Raids: Creating raids with incorrect information
- System Manipulation: Attempts to bypass security or exploit the system
7.4 Illegal Activity
- Illegal content or services
- Fraud, scams, or financial crimes
- Drug dealing or promotion
- Any activity that violates applicable laws
8. User-Generated Content
8.1 Your Content
You may submit content to PokeParty, including raid room names, comments, and profile photos. You are solely responsible for any content you submit.
8.2 Content Guidelines
Your content must not:
- Be defamatory, threatening, or harassing
- Violate intellectual property rights
- Contain hate speech or discriminatory content
- Be sexually explicit or obscene
- Include personal information of others without consent
- Promote illegal activity or violence
8.3 Content Moderation
We reserve the right to remove, edit, or refuse any content that violates these Terms. We may also suspend or terminate your account for repeated violations.
9. Content Licensing
By submitting content to PokeParty, you grant us a non-exclusive, royalty-free, perpetual, and worldwide license to:
- Use, reproduce, and display your content in connection with providing PokeParty
- Create derivative works for safety, moderation, or improvement purposes
- Display your content to other PokeParty users
This license does not grant us the right to sell your content or use it for marketing purposes without additional consent.
10. Intellectual Property Rights
11.1 Our IP
PokeParty, including the App, Website, design, functionality, code, and all original content, is owned by PokeParty and protected by copyright and intellectual property laws. You may not copy, modify, or distribute any part of PokeParty without our written permission.
11.2 Your IP
You retain all rights to your user-generated content. By submitting content to PokeParty, you license it to us as described in Section 9.
11.3 Third-Party Content
PokeParty may include content from third parties. Such content is protected by their respective copyrights and intellectual property laws.
12. Pokemon GO Trademark Disclaimer
Important Legal Notice:
PokeParty is not affiliated with, endorsed by, sponsored by, or in any way officially connected with Niantic, Inc., The Pokémon Company International, Nintendo, or any of their subsidiaries or affiliates.
Pokemon GO and all related marks, logos, and intellectual property are the property of their respective owners.
By using PokeParty, you acknowledge that PokeParty is a third-party service and is not associated with or endorsed by Niantic.
13. Third-Party Services
PokeParty uses third-party services including Firebase Analytics, Sentry error tracking, and Expo push notifications. These services may collect data subject to their respective privacy policies. You are responsible for reviewing their terms and policies.
13.5 Monetization and Rewarded Ads
13.5.1 AdMob Integration
PokeParty offers optional premium features through rewarded video advertisements:
- We use Google AdMob to display rewarded video advertisements
- Watching ads is entirely voluntary and grants premium features
- You can use all core features of PokeParty without watching any ads
- AdMob may collect data subject to Google's privacy policies
13.5.2 Premium Features
Premium features enhance visibility but are not required:
- Featured Friend Code Placement: Paid tiers (1hr, 6hr, 24hr) to increase visibility in the friend code directory
- Extended Quick Share: Watch a rewarded ad to extend your friend code Quick Share visibility to 60 minutes
13.5.3 Free Access
PokeParty is completely free to use. All core features including raid coordination, friend code sharing, events calendar, PvP rankings, and leaderboards are available without payment or ads. Premium features are optional enhancements only.
14. Privacy and Data Protection
Your use of PokeParty is also governed by our Privacy Policy, which is incorporated into these Terms by reference. Please review our Privacy Policy for information about how we collect, use, and protect your personal data.
15. Account Termination and Suspension
15.1 Account Termination
You may delete your account at any time through the app settings or by contacting us.
15.2 Suspension and Banning
We may suspend or terminate your account immediately without notice if we reasonably believe you have:
- Violated these Terms of Service
- Engaged in illegal activity
- Harassed or threatened other users
- Violated Pokemon GO Terms of Service
- Created security or safety risks
15.3 Consequences of Termination
Upon account termination, you lose access to all PokeParty features and user content. While you may request a data export before deletion, we are not obligated to recover deleted content.
16. Enforcement and Moderation
16.1 Our Rights
We have the right to monitor, investigate, and enforce these Terms. We may:
- Remove or modify user content
- Suspend or terminate accounts
- Report illegal activity to authorities
- Disclose information as required by law
16.2 Tiered Enforcement

17. Disclaimers
17.1 AS-IS Service
PokeParty is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, express or implied. We disclaim all warranties, including but not limited to:
- Accuracy or completeness of information
- Fitness for a particular purpose
- Merchantability or non-infringement
- Uninterrupted or error-free service
17.2 No Warranty
We do not warrant that PokeParty will be uninterrupted, timely, secure, or error-free. We do not warrant the accuracy of information provided by users or raid data.
17.3 Your Sole Remedy
If PokeParty does not perform as expected, your sole and exclusive remedy is to stop using the Service.
18. Limitation of Liability
Legal Protection:
To the maximum extent permitted by law, PokeParty and its developers, officers, and employees shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or in connection with your use of PokeParty.
Our total liability to you is limited to $100 USD or the amount you paid to us in the past 12 months, whichever is less. Some jurisdictions do not allow limitation of liability, so this may not apply to you.
Excluded Damages: In no event shall we be liable for loss of profits, loss of revenue, loss of data, lost business opportunity, or any other indirect damages.
19. Indemnification
You agree to indemnify, defend, and hold harmless PokeParty and its officers, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising out of or in connection with:
- Your violation of these Terms
- Your use of PokeParty
- Your user-generated content
- Your violation of applicable laws
- Claims that your content infringes third-party intellectual property rights
20. Dispute Resolution
20.1 Informal Resolution
Before pursuing formal legal action, you agree to attempt to resolve any dispute by contacting us at [email protected] with a detailed description of the issue. We will attempt to resolve the matter within 30 days.
20.2 Binding Arbitration
If informal resolution fails, you agree that any dispute shall be resolved by binding arbitration rather than in court. This includes disputes arising from or related to these Terms, your use of PokeParty, and any products or services sold through PokeParty.
Arbitration will be conducted under the American Arbitration Association (AAA) rules. The arbitrator's decision is final and binding.
20.3 Class Action Waiver
You agree that any arbitration or court proceeding shall be conducted on an individual basis, not as a class action or other representative action. You waive the right to participate in class actions against PokeParty.
20.4 Exceptions
The following disputes are not subject to binding arbitration: (1) claims for injunctive relief to prevent unauthorized use of PokeParty, (2) claims brought before small claims court (if eligible), and (3) claims required to be resolved in a government agency or court by law.
21. Governing Law and Jurisdiction
These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which PokeParty is operated, without regard to its conflict of law principles.
Note:
For users in the European Union, you may have additional rights under EU consumer protection laws that cannot be waived. These Terms do not limit your statutory consumer rights.
22. Changes to Terms
We may update these Terms at any time. When we make material changes:
- We will update the "Last Updated" date at the top of this page
- For significant changes, we will notify you via:
- In-app notification
- Push notification (if enabled)
- Email to your registered account
Your continued use of PokeParty after changes indicates acceptance. If you disagree with changes, you may delete your account and stop using the Services.
23. Severability
If any provision of these Terms is found to be invalid or unenforceable, that provision shall be severed, and the remaining provisions shall remain in full force and effect.
